Biography
Jorge Miranda has over 30 years’ experience in trade litigation. He has assisted parties involved in trade remedy investigations conducted in Australia, Brazil, China, Costa Rica, Colombia, the European Union, Jamaica, Japan, Mexico, Peru, and the United States. Jorge has also been involved in 13 disputes before the World Trade Organization (“WTO”) and two disputes under the North American Free Trade Agreement (“NAFTA”). He has served as panelist in dispute settlement proceedings under the NAFTA and the United States-Mexico-Canada Agreement (“United States-Automotive Rules of Origin”). His expertise concerns, in particular, provisions of the General Agreement on Tariffs and Trade (specifically Articles III, XI, XV, XX, and XXI), the Agreement on Agriculture, the Agreement on Subsidies and Countervailing Measures, the Agreement on Antidumping, and the Agreement on Safeguards.
Before entering private practice in 2002, Jorge was with the Rules Division of WTO Secretariat. In this capacity, he serviced six WTO dispute settlement panels. Previously, he served as deputy director general for AD and CVD investigations, and director for trade policy, at the then Ministry of Trade & Industry in Mexico. Earlier in his career, he was with the Trade Policy Division of the Economic Research Department of the World Bank.
Jorge has authored or co-authored over 20 academic works including A Handbook on Anti-Dumping Investigations and articles in the Journal of World Trade, the Journal of International Economic Law, World Trade Review, and the Global Trade and Customs Journal. He has also been a referee for Cambridge University Press, the Journal of International Economic Law, the World Trade Review, and the Journal of Industry, Competition and Trade. He is a frequent participant in seminars and symposia on WTO issues and has been on the faculty of the World Trade Institute in Berne, Switzerland.
Experience
- Advised the litigants, third parties, or private interests involved in the WTO disputes in Canada-Commercial Aircraft, Thailand-Sugar Subsidies, EU-Price Comparison Methodologies, China-Apparel and Textiles, China-GOES, United States-Antidumping and Countervailing Duties (China), EC-Large Civil Aircraft, US-Large Civil Aircraft, US-Chile-Price Bands, DRAMS CVDs, EC-DRAMS CVDs, US-Cement, and Mexico-Rice.
- Advised the litigants in the NAFTA panels challenging Mexican antidumping duties on imports of Ethylene Gylcol Monobutyl Ether (“EBMEG”) from the United States and Ammonium Sulfate from the United States.
Trade Remedy Experience:
- Obtained a finding of absence of causation in a Mexican antidumping investigation against imports of apples from the United States.
- Played a key role in obtaining a finding of absence of causation in a Brazilian antidumping investigation against imports of caustic soda from the United States.
- Has assisted a multiplicity of Mexican producers in obtaining antidumping duties on imports of products from China, including seamless steel pipe.
